1. INTRODUCTION

Welcome to Books4U ("we," "us," or "our"), an accounting software platform designed to help businesses manage their financial activities. These Terms of Service ("Terms") govern your access to and use of the Books4U software, website, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

9. INTELLECTUAL PROPERTY

  1. The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Books4U and its licensors.
  2. The Service is protected by copyright, trademark, and other laws of both Lesotho and foreign countries.
  3. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

10. TERMINATION

  1. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
  2. Upon termination, your right to use the Service will immediately cease. However, all provisions of these Terms which by their nature should survive termination shall survive.
  3. You may cancel your subscription at any time through your account settings or by contacting our customer support. Upon cancellation, you will continue to have access to the Service until the end of your current billing cycle.

11. DATA RETENTION AND EXPORT

  1. After termination or expiration of your subscription, we will retain your data for a period of 90 days, during which time you may export your data from the Service.
  2. After this retention period, we may delete your data permanently.

12. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT:

  1. THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION
  2. ANY ERRORS OR DEFECTS WILL BE CORRECTED
  3. THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  4. THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS

13. LIMITATION OF LIABILITY

IN NO EVENT SHALL BOOKS4U, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

  1. ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  2. LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  3. DAMAGES RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE
  4. DAMAGES RELATING TO ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE

REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICE DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

14. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Books4U and its licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

15. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Lesotho, without regard to its conflict of law provisions.

16. DISPUTE RESOLUTION

  1. Informal Resolution: Before filing a claim against Books4U, you agree to attempt to resolve the dispute informally by contacting us at info@books4u.pro. We'll try to resolve the dispute informally by contacting you via email.
  2. Arbitration: If a dispute cannot be resolved informally, you and Books4U agree to resolve any disputes through binding arbitration in accordance with the rules of the American Arbitration Association.
  3. Exceptions: The arbitration requirement does not apply to claims of intellectual property infringement, unauthorized use, or violation of Terms that may be pursued in any court of competent jurisdiction.
  4. Class Action Waiver: Any proceedings to resolve disputes will be conducted on an individual basis. Neither you nor we will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity.

17. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page and updating the "Last Updated" date.

Your continued use of the Service after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by them.

18. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Books4U regarding the Service and supersede all prior agreements and understandings.

By using the Books4U service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
